Advocacy in Motion.

We represent consumers, small businesses, and municipalities in antitrust, consumer protection, commercial dispute, and data privacy litigation.

The types of subject matter on our docket are complex and sophisticated, often including cases and laws which courts have not addressed before - which are called cases of first impression.

We not only challenge wrongful conduct, we shape the law to make it more favorable for litigants in the future to be able to have success against it. When we open the door for our clients, we hold it open for all of those who come through it afterward.

At the core of our litigation practice is a commitment to work each day to fundamentally level the playing field through class action and individual cases against the most powerful corporations and monopolies with limitless resources.

Mr. Yagman “currently has leadership positions or is sole lead counsel in significant class actions and multi-district litigation cases in courts around the country [… having] litigated high-stakes cases - including cases of first impression - involving new and emerging legal issues, including algorithmic price fixing, surreptitious collection of biometric data, deployment of surveillance pricing, implementation of evolving digital tracking technologies, and challenging various forms of complex price manipulation.”

Thus, “the Court finds that Mr. Yagman [has] 'deep knowledge of not only class action law and procedure, but of substantive [consumer protection and data privacy] law.”

Our Approach

— In re Gatorade Marketing & Sales Practices Litigation

(United States District Court for the Southern District of New York)

“For nearly a decade, Mr. Yagman has litigated against corporations accused of misconduct at the intersection of economic and social justice.

His work in pricing and data cases includes the first ever consumer class action addressing surveillance pricing, in which airfares were allegedly adjusted according to sensitive information collected about each purchaser, and a proposed class of hundreds of independent pharmacies whose reimbursement rates for generic pharmaceutical sales were allegedly suppressed through algorithmic price fixing by pharmacy benefit managers. His data privacy matters include a data breach case of first impression brought on behalf of a proposed class of over 200 million victims against a social media company, a class of millions of minor plaintiffs in Illinois whose biometric data was allegedly collected by a social media company without adequate consent, and a proposed class of millions of concert and sporting event attendees who allegedly had their biometric data collected unlawfully by a well-known sporting venue.”
